The cost of malpractice insurance is skyrocketing and causing an increase in the cost of medical care as physicians try to pass off more of their insurance costs to their patients. It is also suggested that millions of dollars are wasted on unnecessary tests because physicians want to protect themselves against malpractice. Tort reform laws are being passed in many states in the United States. These laws seek to insure that the injured party is fairly compensated for the physical harm and will have adequate monies to continue care as long as needed, but there is a cap on the amount the jury can award the plaintiff for non-economic suffering (pain and suffering, etc.) There is much debate about the success of tort reform and even questions as to whether negligence is being properly reported and punished.
